LEAVE ENTITLEMENT IN CASE OF ACCIDENT IN COMPANY VEHICLE

Dear Sirs,

If an employee of private sector(manager level and out of ESI) meet with an accident in company vehicle on way to his duty and injured and he has no leaves to his credit(CL,SL,EL etc.) at that time then what is his right and entitlement to leave or other benefits from the company or under various labour and service laws. That employee is also advised rest by doctor for more than one month. Please give your valuable opinion in this matter because it is of urgent nature.

The accident arose during the course of his employment (notional extension as per the Employees' Compensation Act (earlier known as Workmen's Compensation Act). Hence it is obligatory for the company to provide him pay for the leave  (the basic + DA.) and also medical assistance. Even otherwise, as good practice of governance and social orientation, the Company should extend its assistance to such employees.

I agree with Mr. Vasudevan. Welfare of the employee and due compensation is the liability of the employer, if he meets with injury or death during the couse of his duty.

Dear Sir(s),

I want to know the percentage  of medical assistant to an employee if he met with an accident , and how long we have to pay the compensation if it is temporary disablement?
