ENTITLEMENT OF EARNED LEAVE

Dear Sirs,

What is the procedure for availing earned leave. Wheather a person becomes entitled after 240 days or on completion of calender year if days are less than 240. After that wheather we can give these leaves on accumulation after completion of calender year or after 20 days and so on.

Please check out the Shops & Establishment Act, of the location where the establishment is situate. Unless the Company has adopted Standing Order/Service Rules, the Leave rules of the concerned S&E Act applies.

Your query is vague.  You have not specified the nature of employment. The eply will be different if the employer is Govt or private body or PSU.

Section 79 of the Factories Act clearly states that every worker who has worked for a period of 240 days or more in a factory during a calendar year shall be allowed during the subsequent calendar year, leave with wages for a number of days calculated at the rate of 1 day for every 20 days fo work performed during the previous calendar year.
