Approximately 80 percent of divorced

or separated women in India live below the poverty line, with a monthly income of less than Rs.4,000, a survey said.

 

Conducted between October 2008 and September 2009, the survey to determine the economic rights and entitlements of divorced and separated women involved interviewing 405 women across the country. Most of them belonged to middle class and lower middle class backgrounds.

 

Divorces and separations are increasing in India. Yet not much attention is being given to the way separated and divorced women live, often with their children, and what their rights and entitlements are," Advocate Kirti Singh, who headed the survey, said Monday at a conference to share the findings.

The survey found that in most parts of India the majority of separated or divorced women belonged to the 23-32 age group.

"Seventy-five percent of these women live in their natal homes because they have no economic support, and they are not always welcome there. Eighty percent of them have their children staying with them," Singh said.

"It was also found that 58.5 percent of these women were working out of their homes. Only 2.46 percent have better occupations while 21.63 percent were working as domestic servants or labourers," she said.

The survey said that only 1.7 percent of the respondents were earning a "handsome" amount of Rs.35,000 per month. The majority, approximately 80 percent, earn less than Rs.4,000 per month and live below the poverty line.

Another significant finding was that almost half the number of women surveyed had not asked for maintenance. The reasons ranged from ignorance to lack of resources for legal action.

"Also, the court cases took a very long time. The maintenance amount given was miniscule, maybe five percent of the spouse's earnings. Since most of the property is bought in the husband's name, the women are also without any asset," Singh said.

A shocking 83 percent of those surveyed said they opted out of the marriage because of cruelty or domestic violence in their marital homes.

"Most of those surveyed wanted the survey to lead to some immediate benefit. Almost all wanted an equal share in the marital property," Singh said.

wat percentage of families  have per capita income over 4000 per month in india?

india is a poor nation , so wud be its general public. sitting in metros in airconditioned rooms and moving in luxury cars u  cannot see real india. real india is that poor only.

If someone get the survey then the real picture comes.

doctrinal research is limited as it only restricted to libraby not a fieldwork real experience.

Non doctrinal research is law of recent origin and social research is necessary to know the root cause of the problem and then find out the solution.Field work is needed to know the exact situation of india.

This number is higher than the 410 million poor living in the 26 poorest African nations.[4] Estimates by NCAER (National Council of Applied Economic Research), show that 48% of the Indian households earn more than Indian Rupee ₹90,000 (US$1,989) annually (or more than US$3 PPP per person). According to NCAER, in 2009, of the 222 million households in India, the absolutely poor households (annual incomes below Indian Rupee ₹ 45,000) accounted for only 15.6 % of them or about 35 million (about 200 million Indians). Another 80 million households are in income levels of Indian Rupee ₹ 45,000-90,000 per year.[5]


world bank study above says " 80% of India's population lives on less than 2$ a day"


does it mean divorced women are in a better condition than general indian population by squeezing out money from males?

watever it may be. these figures can be read anyway.

real picture can be clear only if there had been a study comparing divorced women to overall indian population.

so above study is of no use unless we have a control group  to compare divorced women to.

ok sir. i agree there is a reason to study poverty among divorced women to find if they are more affcted than general population.

but if say world bank as above  says 80% of indian population is poor and also this study says 80% of indian population is poor then this goes to show that poor men have poor divoced wives.

my view point is while doing such a study it should be shown that as a result of divorce women suffered some economic adversity whic affected them more adversely than the general population. which this study doing group has gravely missed.

if a study was conducted which compared each divorced women economically to her ex-husband then it cud serve a useful purpose.

if such a study as i have discussed above is done this can show us how much economic advesity women suffer because of divorce factor in their life all other factors being equal , this shud have been a case control study as per statastical terms.

ROOT CAUSE OF DIVORCE  IS FAMILY UNREST, MARRIAGE WITHOUT MATCHING THE TEMPARAMENT, CULTURE ETC.

ROOT CAUSE OF POVERTY IS LACK OF PROPERTY, PROPER EDUCATION, EARNINGS ETC.

ONE PURELY INDEPENDENT WITH THE OTHER.

AMONG THE POORS, THERE ARE A SEPERATE MARRIAGE AND DIVORCE CULTURE GOING ON. THEY DO NOT BELIEVE IN DIVORCE. THEY DO NOT HAVE FAITH ON COURT. A STRAIGHT AND SIMPLE ACTION  THEY TAKE - AFTER REALISING THE IRRITRETRIAVEABLE BREAKDOWN OF MARRIAGE, -

THEY FIRSTLY SEPERATED FROM ONE OTHER

SECONDLY THEY SEARCH A PARTY FOR SEX, AND DO IT.

THIRDLY, IF THE PARTY FOUND SUITABLE START LIVING TOGETHER.

AM TELLING IT FROM MY REGULAR EXPERIENCES NOT FROM ANY RESERCH WORK.

AS THEY ARE POOR THEY DO NOT LIKE TO GO TO CURT AND ALSO AS IT IS A CIVIL MATTER, THE COURT HAS A LITTLE SCOPE TO INTERFEER IT

yes you are right arup, there is no divorce in poor. as there is no immovable asset , u cannot trace them also. ur observation is very correct.

SO IF WOMEN IS BELOW POVERTY LINE IS BECAUSE OF HUSBAND OR HER PARENTS WHO HAVE NOT GIVEN HER PROPER EDUCATION TO EARN HER BREAD AND BUTTER

 

INSTEAD SHE SHOULD CLAIM FROM HER PARENTS

 

There should be equilibrium in law and justice and its should not be gender biased.

 

Today women is claiming ,maintenance whether they have any real problem with their husband or not but they are claiming it as a matter of right and it becomes business now to earn easy money. Marry the rich person , do quarrel with them and then claim maintenance and alimony. When she is not ready to co-operate and take care of her husband and family then why she should get any maintenance/alimony. IT MUST BE STOPPED AND BE GIVEN ONLY IN DESERVING CASES WHERE HUSBAND IS GUILTY AND WIFE IS INNOCENT.IT WILL SAVE THE FAMILIES.

 

It is a jungle raj and  way to become rich on others money.

 

If husband has duty to maintain her wife then wife has also duty to take care of him and give love and affection. So there should be no maintenance at all for wife's who are just trying to enrich them by using this ANDHA KANOON.

 

 

Certain suggestions to preserve families and to save them:

 

          No maintenance till guilty is proved and if husband is ready to reconcile and bear all the expenses of wife and children if she re-joins him.

 

          No maintenance  and alimony in the 2nd marriage if she has got it in the first divorce.

 

          No maintenance if she can maintain her or her parents can maintain her and if husband is ready to take her back.

 

          Compulsory mediation for avoiding long legal battle.

 

          Law should be such that both husband and wife try to reconcile .

 

          Law should not be favoring anyone to ensure that marriages are saved.

 

        

      Domestic violence complaint / fir should be filed within 24 hours of alleged incidence in place of today's situation in which wife and her parents try to black mail the husband and his family to agree to their terms and if they do not agree then they file case even after many years.

 

 

DV Act must be applicable equally to men and women as today women is more aggressive and ill-treat, abuse, beat husbands and in-laws but the DV Act not applicable to them. It must cover wife's and their families to ensure equality and justice.

 

 

Limits provided in the Act for filing mutual consent Divorce after 1 year separation, desertion of 2 year,3 years for IRBM etc. should be removed and it should be only 3 months so both can start their life’s afresh.  When two persons can marry without any waiting period then there should be no waiting period for separation.

 

The most important thing is to fix time limit for completion of hearing and disposal of case in any court say 6 months only. The cases must be tried on fast track basis. The infrastructure of the legislative system should be strenght4ened and cases must be disposed off within 6 months.

 

For filing cases some minimum requirement of proofs etc. must be there and it should not be like this that for any small small issue anybody can go and file the case.

 

Specially for family matters pre-litigation mediation must be compulsory and the behavior/flexibility of each party in resolving the issue must be recorded and should be base of their case in future (if any).

 

Pre-neputal agreement should be made legal so husband and wife are aware before hand what they are going to get or loose if they part there ways and they should be allowed to take divorce on the terms mentioned in the agreement without going to court. 

 

MAXIMUM LIMIT OF MAINTENANCE AMOUNT BE FIXED IN THE ACT ITSELF TO STOP ITS MIS-USE

 

THERE MUST BE STRICT PENAL PROVISIONS FOR PETITIONER AND ADVOCATES FOR FILING FALSE CASES.IT WILL REDUCE LARGE NUMBER OF FALSE CASES. AS PER STATATICS 95% DOWRY/ DOMESTIC VIOLANCE CASES ARE FALSE.ONCE JUDGES START PUNISHING THOSE INVOLVED IN SUCH CASES THERE WILL BE SEA CHANGE.

 

Dowry law, Hindu Marriage law, Domestic violence Act etc. must be made equal for both husband and wife. Lacs of husband are suiciding because of these biased laws.

 

 

FILE  REPRESENTATION BEFORE COMMITTE OF PETITIONS OF RAJYA SABHA FOR CHANGE OF 498a TO STOP ITS MISUSE BEFORE 30.12.2010

 

If husband has a duty to maintain his wife then he must have some rights also and if wife has right of maintenance then she must have some duties also.

 

The government of India who has enacted this type of illogical law has on its own part giving this type of maintenance/allowance etc. to citizens of India if they don’t have any earning/job etc. NO not at all.

 

In NAREGA they are just giving guarantee of work for 100 days and wages for the days worked so this should also be applicable to husband and wife also.

This blackmailing by wife's must be stopped forthwith.

I am a bit confused. Is it that poverty is a pre-condition for divorce? Or that women go under poverty-line as a consequence of divorce? I believe the latter is true. I have been thinking that divorce is a luxury indulged in by the rich.

Desertion and divorce lands up most of the women in nowhere, in all respect like financially emotionally. It is a tough trauma for genuine women.
