Research says 50% Indian women have to SUE,to get alimony

'50% divorced women have to sue for alimony'

NEW DELHI: In a grim reminder that maintenance laws in the country continue to be weak and skewed against women, an independent study has found that over half of separated or divorced women were fighting legal battles for alimony in the absence of little or no financial independence.

Indicating that despite inefficiency of the legal system, women were dependent on it to access their right to maintenance, a study by Economic Research Foundation said of the 405 women interviewed 213 had asked for maintenance.

About 47.4% of those surveyed — that is almost half — had not asked for maintenance. The reasons ranged from not knowing that they were entitled to it to not having the financial means to move courts or choosing not to be dependent on spouse. The survey — Economic Rights and Entitlements of Separated and Divorced Women in India — reached out to women across the country.

"In reality the right to maintenance does not provide women adequate financial support to be able to live in a manner similar to the manner in which they lived during the subsistence of marriage," Kirti Singh, an advocate said.

Situation is more grim, especially at semi-urban and rural areas.

It shows an urgent need of women empowerment(and education) in India so that women do not waste their time in courts, asking alimony and paying fees, time consuming procedure etc. It’s a husband duty to give alimony so that women don’t enter in a court  and also women should remember that she is independent and having qualification and to work like a men .she should standup on her own.

Women`s education in India has been one of the major issues of concern of the Government of India as well as the society at large. It is because of the fact that today the educated women play a very significant role in overall development and progress of the country. Women hold a prominent position in the Indian society as well as all over the world. However, since the prehistoric times women were denied opportunities and had to suffer for the hegemonic masculine ideology. Thus, this unjustifiable oppression had resulted into a movement that fought to achieve the equal status of women all over the world. Women Education in India is the consequence of such progress and this led to the tremendous improvement of women`s condition through out the world. Nevertheless eradication of female illiteracy is considered as a major concern today. In the recent era, the Indian society has established a number of institutions for the educational development of women and girls. These educational institutions aim for immense help and are concerned with the development of women.

We put a special focus on empowering women and girls, because we believe they hold the key to long-lasting social change in communities. Empowering women must be a united approach, a cause that requires continued attention and stewardship by all. We need to augment our efforts for empowering women and enhance their progress. It is our moral, social and constitutional responsibility to ensure their progress by providing them with equal rights and opportunities.

Today women with their smartness, grace and elegance have conquered the whole world. They with their hard work and sincerity have excelled in each and every profession. Women are considered to be more honest, meticulous, and efficient and hence more and more companies prefer hiring women for better performance and result.

Ever heard of following prevailing situation currently in hand?

"Allow alimony for divorced spouse either man or women, whoever needs it more and based on contribution to long marriage. This is settled practice of Law in other countries, so no need to go to 16th century mindset of protecting abla-naaris. Who dares give alimony to women CEOs of ICICI, HSBC, Axis banks clubbed with socialites working for UN funded feminist NGO”s and yet dare to say “hey listen na I barely able to get work for even 45 days a year and ops it is spread out un-evenly for 12 months !"

?

"Currently, it has been seen that alimony is taken as lifelong pension for wives for marriages as short as  a week ops 1 night and first thing in next morning HE is declared impotent clap clap . The marriage was done presumably in pressure, another boyfriend; and alimony is the sweet reward and a great escape from DUTIES syndrom."

@Kushan Vyas

I feel its a research which was peculiarly based on matrimonial transaction over money. NOT ABOUT EQUALITY or something as expressed by you.

The lust for money seems at its paramount and may that be for that matter a male or a female do not wish to part from their hard earned money. Maintenance in 50% cases is challenged and demanded by wife but does this research reveal that out of these cases how many are genuine? I think nothing has been published by the newspaper in this regard.

Its a myth that Maintenance is a right. Its primarily a duty which unequivocally lies on the husband. But if wife goes against the natural conduct in the matrimony, husband has the right to escape this duty and in default this so called right is curtailed. Thats the basic feature of maintenance. I do not know why, people see it in a wave of emotional saga.

If wife is not ready to do anything for husband then she should not get any maintenance/alimoney at all.

It is legal tool of extortion of money from the husbands, many girls marry only to get enrich and their parents also support as they also want to enjoy life on other's money.

Even government is not providing any free money to even beggars then why these free money to these greedy ladies. They should work and earn for themselfves instead of this day light robbery.

All these demands are from ladies belonging to lower class and lower middle class families who have not seen anything in thier parents house.

A divorced wife must not be entitled to maintenance--- for divorce happens for two reasons: Either the wife is wrong and the husband has got divorce proving the wrong doings of wife. In this case, no reason to give any maintenance to woman. In other case, husband is wrong and wife got divorce--- why to take money from a wrong person?

Anyway, the research clearly shows the true nature of marriage- a tool of exploitation of men. An institution where women wants to enjoy fruits of labour of men- before and after divorce.

The research paper also gives some intresting finding. Women are poor because they are not getting maintenance!!! as if it is duty of some person to make them rich. And it appears that maintenance is a "economic right" of women!!!! If that is so, whay not extend this economic right to "POORS" so that they can claim maintenance from "RICH", when they need money. Rubbissh. The research is a step forward towards encouraging feminist parasitism.

But, it will not happen on cost of men.
