Divorce Grounds

Dear friends, a boy and girl went for registered marriage in August 2008 when studying in college. Apart from the registration they didnt live as husband and wife even for a single day. Now both of them are interested in divorce. But the boy now is working in a distant place and says that he cannot come to the court for filing mutual consent petition and says that he will not object to any petition for divorce filed by the girl. Now what is the ground available for the girl to file divorce petition. The parties are Hindus. Thank you.

Please Refer Hindu Marriage Act, 1955. There is a provision for divorce by mutual consent under section 13B. In this provision if both the partis files a petition for divorce. Divorce is granted by the court at the same time no allegations will be against each other. I am attaching the file kindly download it

let girl apply for cruelty and desertation ground of HMA.

it will be ex party decission, both party will get divorce.

mr kush, boy already showed unwillings on mutual divorce. he has no objection on divorce. therefore the above is one way the another way is sec 14 hma. better ex party.
