cheating by home loan lending bank

I have received a call from my bank that i am able to get a top up loan against my home loan of rs 30000 at interest rate 8.40. I did appl wey for it and given the fees of rs 3000 for it. After that i got a message that i will get only 47000 and the interest rate would be 8.60. I mailed them to this discripency but they did not reply. However i was in need so I took the loan .but after one month I submitted back the entire amount of loan. My question is can I apply in consumer court for there cheating?
