The arrested person will be produced before the Court having jurisdiction and, after formalities, shall be released on Bail if it's a bailable offence.    If it's a non-bailable offence, it rests with the Court's discretion to or not to grant Bail.       After 90 days in remand, a person gets Bail provided he fulfils the formalities.

In the case of certain offences, Trial Court doesn't have discretion of granting Bail.     Then one should approach either Sessions Court or High Court for obtaining Bail.     Here also it's up to the discretion of the two Courts.

Sessions Court and High Court have equally unfettered powers in granting Bail.    Bail granted by Sessions Court can be cancelled by High Court but not vice versa.
