Written statement - in a civil case

Hi,

i have filed a written statement in a partition suit case in banglore. my brothers had filed a partition suit for a ancestral property and  i have given my written statement on my behalf.i am one of the daughter asking for share and we in a hindu family.

i have now decided to withdraw my replies it but the case is in evidence stage. how should i go with it . i wanted to withdraw since i know i will be unable to prove some facts stated and some could de -ve to getting my share and what happens if i dont show up for cross examination or in trial. will it be set ex parte on my behalf and will there be any fine imposed on me .i had hired a lawyer just to file the written statemnt and he doestn reply anymore.

You had engaged a lawyer just for filing the reply, as per your post.

If the lawyer has done that part, then that completes the agreement/task.

rather then withdrawing the written statement file application under order 6 rule 17 cpc to amend your pleadings in written statement . feel free to call.
