Under Order 8 Rule 1 of CPC, The person who received summons from civil court has to file written statement before 90 days of such receipt of summons ( Max Time). This is in Civil cases. But I have not understood ur message clearly ...whether it is civil case or any other matter. Please give some additional info ...sothat we can give appropreate answer

Counter claim must be filed alongwith the written statement.
