Withdrawl of FIR u/s 376 IPC

A has been registered u/s 376 IPC now the complainant want to withdraw the complaint.. As mutual settlement of both parties... What is the procedure... 1.. On account of parties.. 2...on account of Police.

You can file petiton u/s 482 crpc for quashing of fir on ground of mutual settlement . HC will decide wether quashing is possible by considering all allegation mention in fir

Accused can file Petition U/s 482 of Cr P C to quash said FIR on ground of Mutual Settlement between the parties by mentioning the terms of Settlement.

Police Will continue with their investigation if not stayed by Court. So, file for quashing and seek stay.

No no.it is a false complaint .now lady understood the gravity of her complaint and problem could be inflicted on that person ..she want to withdraw her complaint.... Should she go for her statement u/s 164 CrPC???????

if she wants to withdraw the complaint she can say in her statement u/s 164 crpc. It will be more easy to withdraw the case.and police will it self file the closure report.
