1. Husband filed divorce in district court, wife filed rcr in family court same jurisdn.
2. wife just appeared for 1st hearing in div. case, NO SAY , NO CROSS passed against wife .....now tday arguments over, her lawyer nor she appeared till date ..... and hon. judge gave a date 12th april for judgement.....
QUESTN:- a. will decree be passed for annulment of marraige in next date declaring null and void???
b. in her RCR + 125 CRPC i filed affidavit as ready for co habitation be its wife who deserts and inflicts mental cruelties......OF COURSE THE CASES WOULD BE CONTESTED ON MERITS BUT...... will my RCR affidavit copy can be used denying divorce .....may be by proving CONDONATION OF ACTS as i mentioned co habitation acceptance?????
please guide me experts and if yes then hoe to defend???
MCD , they asking for moon and stars i mean a huge one time amt....too much for me.....
