Where can wife complain for dowry and dv?

I stay in city1 my family member stay in city2 and my wife's family stay in city3.

As I never went to city3 after marriage how can she give complaint in city3.

Can a wife file complain in any part of India?

Any aggrieved person can file a complaint (FIR) as and where he/she feels comfortable. It the duty of the receiving official/policeman to transfer the case to the correct police-station.

 

In your case, it is quintessential to first read the filed complaint. If all the allegations as per the complaint belong to city-1 then there is no case made out at city-3 and such FIR can be quashed per se. However subsequently another FIR in city-1 shall be lodged automatically.

 

For further explaining your query, if your wife has been successful in getting the complaint registered in city-1 and you have the copy of this FIR, then you have to move to High Court of that state and pray to quash this FIR and get the case transferred in the correct area o jurisdiction.

Your answer is not correct as far as my understanding of criminal cases is concerned. In my view any jurisdiction is valid wherein the crime has been committed and not anywhere else.

 

Pls clarify if you feel like..

Dear Mr. Saurabh

Please confirm, if the marriage has taken place in city 3 but no cruelity has ever taken place there..  Then as per Jurisdiction can a case be lodged in city 3 and can other party tranfer this case to city 1 on the grounds that no cruelity has taken place in city 3

Still there is no clarity whether a case can be filed in city 3. Mr Shonee.. Please elaborate ?

498 A and Dvc can be filed 

1. Where the harrashment took place

2. Where the women presenly resides with continuous harrashment (mental agaony)
