What is the value of sleep-talk audio recordings?

My cousin who lives in Kolkata is planning to file a case against his neighbor. His neighbor knows that. My cousin has the habit of talking loudly in his sleep. The talks are of course sometimes meaningless, sometimes meaningful, and sometimes full of slangs (Sample: "I will kill you, ******************, I am not mad, you guys are, **************"). His neighbor has recorded these over a course of three months and is planning to use these huge no. of audio recordings in the court to prove that my cousin is a violent mad criminal. What should be our strategy?

It is amusing to note the company you keep. sometimes your acquaintances are captured on video behaving strangely, sometimes their waste is picked up by neighbours, at other times their sleep talk is captured on audio. These cannot be utilized as evidence.

Instead of presuming things, face the situation thereafter as and when it comes.

The posts might sound amusing but sadly they are real. I believe framing a person in a false case or proving a talented person is a violent mad criminal is a pretty serious issue and I would be happier if you could focus on the question instead of how it looks from the surface.

You are claimimng that he has not contorl on it apparently it is due to some abnormal or medical disorder then a Medical Specialist can diagnose, certifiy it, and traet it, if it indeed exists.

 

It may be his defence.

Thank you for your reply. Why do you think preparedness is bad?

Preparedness is not bad.

But there can be many presumptions,probable & different circumstances. Painting a picture based on presumptions is not viable.

No valuable views can be expressed based on the probable guesses.

Such recordings are not sufficient to prove the accused to be a violent, mad criminal. You may proceed against the accused under civil law on ground on 'nuisance'.

Sleep talk cannot be a reason/ground to proceed against the accuse under civil law. 

Accuse is not doing this in consciousness.
