Please tell What is the process of MCD?

What things are require for first motion of MCD

1) How many witness from each side?

2) Do require photos(snaps)/residential/ID Proof etc?

3)What will be the court fees?

4)During the final/2nd motion after 6 moths do witness require again?

More than anything else what you require for MCD is a willing cow. She besides the observation, here are straight replies;

 

For 1: You require a Advocate. Via an Advocate he should make Index Sheet, Memo of Parties, Petition U/s 13 (B) 1 HMA, Marriage Photo of parties, 1 P/P of each parties, Residence proof along with Notarised Jointly Executed Agreement / compromise Deed.


For 2:
There are two acceptable ways on witness deposition adopted by court; One common Advocate of parties can identify both parties OR 1 witness known to respective party from respective side whichever is convenient is the way out of a marriage !


For 3:
Yes both parties need to submit 1 PP of theirs, Residence Proof, Photo ID proof, Marriage Photo or Registration Certificate.


For 4:  
Your Advocates will do the needful on court fees as well as Advocate Welfare Fees which are very very nominal and not going to give you heart attack. Better here if you would have asked how much average Advocate Fees would be for MCD

For 5:  Yes during second motion also witness are required which could be more or less same as stated in para 3.
