S. 498a IPC has become so diluted now-a-days and is behaving like ordering 'butter-chicken' from a Punjabi Tadka corner shop...... 
 

1. She should be immediately booked under S. 307 IPC where husband - his side has to just show the act, irrespective of its result, was done with the intention or knowledge and under circumstances. [AIR 2009 SC 1642]


2. Undue sympathy to impose inadequate sentence would do more harm to the justice system to undermine the public confidence in the efficacy of law and society could not long endure under such serious threats. It is, therefore, the duty of every Court to award proper sentence having regard to the nature of the offence and the manner in which it was executed or committed etc. under S. 307 IPC. [AIR 1991 SC 1463]

As rightly observed by Mr. TajobsIndia, it is high time that the government should seriously think of repealing section 498a or modifying it in a different mode that the innocents are not victimized to it.

Blood y government.  Lawless laws.  Such things can only be avoided by bringing amendment to laws, but no politicians is bothered.   If we elect people like Hema Malini who is a second wife to Dharmendra and Rekha who was a wife to many men in her lifetime, Jaya bhaduri; we could only expect more laws like 498a, DV etc.


My take is, politicians should face the brunt of these laws which they created, only then will the think of changing existing biased laws.
