Weekly hours rule setting in india

Its a query on how to set weekly hours rule in India. We would like to comply with all the laws and want to make 40 hours total working per week excluding lunch hours. Is there any law to mention what could be the maximum working hour in a day employer can legally make in the weekly hour rule. Kindly help

Look into Shops & Estbs Act, Factory Act depending upon the establishment and concerend Dept/Div is covered by which Act.

You can set weekly work hours at 40hrs.

My query is about the maximum limit of daily working hours in the Weekly 45 Hour Concept.    This is for a software company in India and the spirit of 45 hours per week including lunch breaks for 5 days working will be spoiled if we set maximum working hour rule per day.   Minimum working hours per day is set for 4 hours only here. Is it mandatory in law that employer also has to set maximum working hour rule for a software company which is not demanded from company but choice of employee to work on their wish in the weekly 45 hours rule.  This will only to help employees to work only for 4 hours on remaning 2 or 3 days in a 5 day work week.

Software companies are covered by Shops & Estbs Act of the state.

Look into this Act of your state where you are based and operate.

You will find your answers.

Generically speaking: 8/hrs day=48 hrs /week.

Break after 5 hrs.

For max. hrs/day, capping on OT look into the Act.

Or engage an able Labor Law Consultant/ Law firm for all such issues.
