Any citizens' rights/liberties end at the tip of his nose. Every tenant in an apartment has equal rights over the common area. You can as a law-abiding decision decide your rights and contact a local advocate for guidance with your arguments and seek his advice on a further course of action, at the cost of permanent neighborly relations in apartments. When there is a resident society with such powers you have to obey the orders of that society which is having final say in common area.
