Unregistered will

sir

my grand father acquired some land in his name. he died 50 years back.
10 years back his daughter gifted that land to her relative stating that her father has given that land to her through unregister will , this will is not available now. and the land is not transferred in her name from last 40 years . now where can we get the will,
to know whether it is actual or fake.

You can check documents at Sub Registrar Office.

Once documents are at hand then anything can he said.

The will must be in the custody of your aunt.     You can't get it to make sure whether it's forged.

You can institute a Suit and obtain injunction.    The will then come to light.

There's an alternative.    Don't allow the man who received the land under gift deed to cultivate the land.     A criminal case will be filed against you and during inquiry you can tell the police about the genuineness of the will.

This alternative may prove to be dangerous if the will is genuine.

Take one step at a time:

Step 1: Thru a lawyer, send a legal notice to Aunt asking her to provide copy of the Will to you .

Step 2: Thru your lawyer, send a legal notice to the buyer of land asking him to tell you whether a Will was shown/given to him before the said property was sold to him. 

Also, check and get copy of documents from subregistrar's office stating whose name this land was when it was sold.

Once you receive a reply , then you proceed further legally.
