Two rcs- can there be two paralllel recovery proceedings !

Dear Members,

 

I would like to know whether there be two parallel proceedings for recovery of loan by bank.

One by DRT under RDDBFI Act, 1993 and another by Public Moneys Recovery of Dues Act, 1973.

I have been issued RCs by DRT Dehradun and also another RC under UP Public Money Recovery of Dues Act, 1973 by Collector Haridwar ? How can the same be justified ?

And one thing more, my loan account had never ever been categorised as NPA.

What remedies are available with me ?

And is there any rulings/law that bank cannot proceed in such two ways. I need HC rulings or SC rulings.

there cannot be two RC for same debt.

I need the opinion of other members also. i understand that there can't be two RCs for the same debt but Is there any precedent in which both of the RCs have been stayed because amount in both the RCs are different and wrong and also required further adjudciation. 

 

DRT is demanding laws, precedents & other such things ?

What to do ? a lot of panic is disturbing me. I need help and opinion of other members also.

Bank has issued a RC  under UP Public Money Recovery of Dues Act, 1973 and simultaneously Recovery Certificate by DRT had been issued against me for the same debt ?

What else do you need sir ?
