Trademark transfer

Dear Sir/Madam,

Please advice me in the following case.

What is the procedure for transfer to registred trade mark from the company name to its director of the company, because he want to sell his company but want to retain his brand, so here want to transfer the brand to his name.

Your querry is not clear.If the company has different products and the trademark under which they are sold are registerepd in different clasosoes then the company may sell the particular trademark to the director who can purchase it in his individual capacity..As far as trademark is concerner some goods or services should be present. However  a company may register its name under the companyies act .for example  hindustan unilever ltd has registered their name with logo in a stylised manner under the companies

act and they have registered different products like detergent under tranemarks like rim, wheel etc.THey can sell a particular trademark to any person.This has to be done before the whole company  is sold to a third partyONly trademarks can be sold THE purchaser of the whole company has the right to the logo etc registered under the companies act

Anyone whose name also identifies a business or profession should consider trademarking their actual name. If you are considering establishing a trademark for your name, you should first perform a trademark search or by going to the Patent and Trademark Office, to determine if it is claimed as a mark by someone else.

Even if you do not register your name you can still use a mark you have adopted to identify your goods and/or services. Anytime you claim rights to a mark, you may use the "TM" (trademark) or "SM" (service mark) symbol.

But registering your mark will offer you added protection under trademark law, including giving you the ability to bring action in court concerning the mark and obtaining registration in foreign countries.
