Torrent

Hi

I have few queries and appreciate if somebody can respond quoting relevant sections in law

1)Is is illegal to host a new unrealised (new movies) movie in torrent?
2)Who is punishable the downloader or the hosting website?
3)if the person downloading views the movie only for his personal viewing is he punishable?

thanx

As with any downloading technology, you should not download copyrighted materials such as software, mp3, movies and so on. If you do not have the licence for it, it is illegal. There is an additional problem with torrents - in certain countries "only downloading" movies and mp3s is legal, however when downloading with torrents you also share (upload) your downloaded part - and that is not legal anywhere (you are distributing copyrighted material which you do not have a licence to).

Of course, torrents themselves and all around them is nothing illegal, until you download materials you shouldn't. Torrents are also used for fully legal distribution of certain data ( for example demo versions, trials and so on).

Hello Vimal,

1)Is is illegal to host a new unrealised (new movies) movie in torrent?

Yes under copyright act

2)Who is punishable the downloader or the hosting website?

No one

3)if the person downloading views the movie only for his personal viewing is he punishable?

No

The Technology used by torrent is so complicates that u cant trace the provider & downloaders

so u cant punish them

if u want to trace then u need to invest to bribe the police to help else no one is going to this boring job.

who is going to trace more then 10000+ ips for a movie ?

so practically its not possible to take them court

TIP: Movies are not uploaded to hosting companies servers .so u cant sue them.

all torrent sites are only indexer like google.

even goolge show torrent files so can u sue google ?

if u want to fight then u need to start from google to win.

Thanks

Internet is a free space where every thing is shared. It is a place where information is absolutely free and all types of exchanges should be possible. It is a principle for which users have been fighting through the years. Unfortunately big multinationals and vested interests are trying to erode this fundamental liberty. There are cases going on against piratebay isohunt and other torrent sites. There is also a variety of software workarounds so that the identity of person downloading the torrents is hidden. In India, where people get away brazenly with murder and all kinds of heinous crimes, for example against poor downtrodden dalits, who is bothered about a few pirated movies?

If your conscience is troubling you, there is noone forcing you to download such content or preventing you from buying licensed versions.

Vishwa.
