Title clearence report

i am in process of purchasing propriety builder is refusing to provide title clearance and 7/12 as he is telling this is responsibility of buyer or bank. please guide

Title clearance certificate is provided by a property lawyer. If you live in Maharashtra (where 7 1/2 procedure is followed), your lawyer needs to do the following checks:

  1. 7 1/2 extract
  2. Loan on premises/if premises is tenanted
  3. Cultivable/non-cultivable area in the property
  4. Property assessment
  5. Class of property
  6. Reservation of/on property
  7. All mutations on the 7 1/2 extract
  8. Maps
  9. Ceiling limit & that seller/vendor does not hold the land as excess land
  10. Holding status of owner
  11. Legal heirs of the property owner
  12. Whether any court cases are pending regarding property to be sold
  13. Whether any land acquisition court proceedings regards the to-be-sold property are going on?
  14. Whether the property to be sold falls within CRZ area?
  15. Income tax clearance certificate

You can also write a letter to BMC (assuming you live in Maharashtra) to find out whether there are any arrears of municipal bills/riot bills/water charges. Prior to closing your sale deed, you not only need to conduct routine enquiries, but also raise any objections as to title/conveyance defects. Only after all these points are satisfactorily concluded will question of drafting a sale deed arise.
