Third party interference in partition of property

Sir/Madam

Among our siblings, we are going with partition of our mother's intestate property. But our father recently expired. My doubt is, my father's second wife(widowed) is involving in property matters and may file a suit in the court of law. She claims to having a Will from my father (doubtful). IF we have our property partitioned without her involvement, can she go to court? what is the limitaton of time for her to go to court? I heard that it is useless to file suit after 6 months after partition of property. Kindly reply.

The second wife (legally wedded) at the most may stake a claim for share in husband's share.

 

You may proceed further under expert advise of your able lawyer dealing in property/civil/family matters.

is it your mothers self aquired property or it was inherited from your father

did your father too die intestate

did your father marry the second wife when his first wife was alive

in which place is the property located
