Theft caught on camera

Dear Members,

Recently, 3 employees were caught stealing in our cctv cameras installed in our shop. The manner in which the theft was carried out was absolutely impeccable. The manager took out dumped up soiled/damaged notes out of the cash drawer and gave it to a salesman for counting. Meanwhile, as the manager goes inside the storage room, second salesman comes to the first sallesman's side and picks up a notebook to block off the cameras' vision. On the other hand, a third salesman moves into action and we see him lift the computer key board, sliding his hand underneath it, and grabbing something in his fists, he pulls it back and puts his fist into his pocket. 

 

The second salesman who had been guarding meanwhile, leaves the notesbook back where it was and commences his work. All of this took place under a minute.

 

Now, we did not have an accurate figure of how many notes were present. On confronting the 3 employees, they denied accepting this incident, and after showing them the video, they made up a story that they were passing gutka. 

 

So how strong is my case if it goes up to the labor courts? Please advise. We were unable to terminate such employees who had been embezzling due to lack of proof and strong trade union. Now that we have evidence, could we win this case?

first lodge criminal complaint with police. issue showcause notice and seek their explanation. Based on their explanation conduct domestic enquiry. Based on the finding initiate action as per law.

Posession and consumption of Gutka is also banned in several States! if this ban covers your regional as well, you can initiate action against dealing in gutka, which is admitted by the employees!
