Termination from service- rules

Dear All,

               Vande Matram,

 Kindly inform whether termination from services order can be set aside on the sole ground, if the any of the necessary conditions attached with the termination order, is not fulfilled?

Pl. also supply relevant SC case laws in the matter.

query repeated with same vague details.  you may consult a local service law practicing lawyer for further details if your own lawyer is not responding properly.

My simple q. is: When the necessary condition for a valid termination order was fulfillment of one of these condition, viz., 1. either serving of 1 month's prior notice to del. off., or, 2. Payment of 1 month's salary in advance. The del. off. was terminated without fulfilling any of these conditions, and the Hon'ble S. C., ordered for the payment of 1 month's salary to the del. off., & refused to set aside the Termination order, merely on the ground that none of the mandatory conditions prior to termination was fulfilled. The termination order in such circumstance, was not held to be bad. Pl. supply me the citation of the relevant case law.
