Tenant not vacating

We have rented a shop and the agreement was made 10 years ago. The tenant are two partners and both their names are mentioned in the agreement. Now there is only one partner. 

We want the tenant to vacate the shop and we had a talk with the tenant a year back to vacate the shop and we gave him one year time, no paper work was done, just mutual understanding. Now when we ask him to vacate, he says he cant vacate the shop or at least for 5 to 6 years.

Please suggest what can we do in this situation. How can we make him vacate the shop. If we have to go to the court, can we make him to vacate the shop and how long will that take.

Sir,

Indian States have their own rent acts, you can get possession from your tenant subject to the relevant rent act of your state. Please, therfore, inform the state that you belong ton.

You may consult a local lawyer and issue a legal notice asking him to vacate for the reasons which you rely upon and after that you may file an eviction suit.  It will take years to get disposed.
