Tenant absconded-not showing up to vacate or pay rent

Dear Legal Experts,

We are facing an issue with our current tenant. He is not paying rent, utility bills and has absconded from over 6months. We have lodged a police complaint but they are not helping us find the tenant. Everytime when the police calls up tenant he comes up with a date to come home and settle the things. The wait has failed over repeated attempts.

Having did a bit of background check on this tenant got to know that his chit business ended up in loss and lot of people invested in him are hunting to get their money back and hence he is not showing up to vacate nor come in the vicinity of the house fearing that the people would beat him up black and blue.

Rental agreement was not made initially because he wanted to stay for less than 6 months. Tenant was introduced through know contacts hence agreed . He paid a deposit of 50k initially so we had the confidence to allow him for a shhort period of stay.

How can we now initiate legal proceedings on that tenant and ensure he vacates the house and pays up utility bills atleast. Myself and the house is at Bengaluru. Tenant hails from tamil nadu

You can give legal notice for recovery of rent and vacate the premises through local lawyer.

We dont know about his address where he lives, all we have is the phone number. Is there anyway of sending the notice?

Sir, Each State has its own Rent Control Act, you may issue a notice of eviction as per the prevelent Law of your State. This is a civil matter and Police won't be able to help you. You may send the notice of eviction at the address of the premises you have given on rent. Good luck, Kishor Mehta
