Takeover of private land for road widening without consent

There is a road widening being undertaken to accommodate traffic that will pass through it towards railway underpass as flyver bridge is being constructed on the Railway Crossing of Umbergaon.

Private property is being taken over for the road widening work with out any consent or compensation. I am loosing 22.96 sq feet area from my front yard while some are going to loose a part of their house.

What does the law say.

Considering you legally owner of the property(sale and mutation papers) are in your name. If is ancestral property then only mutation papers is required. No authority can take land without your consent unless there national interest, if widening work is of national interest they will you pay consideration in exchange of land.

Land acquisition can be resorted to by competent authority.     Giving Notice is compulsory.      Your consent is unnecessary.     Compensation prior to acquisition is perhaps legally necessary.

Now days goverment is giving good amount of compensation for land acaquisition. Acquisition process includes issuing notices paper publications etc.

Check carefully.

Notice might have appeared in newspapers…

If  NO compensation has been paid, meet the authority that is taking over and constructing…

They may like to end the disptues and claims..and may pay.

If you are unable to handle on your own Discuss in person with a very able senior LOCAL counsel of unshakable repute and integrity specializing in revenue/civil matters and having successful track record ….. and worth his/her salt … and show all documents of property  for a considered opinion ….

Your counsel shall do the needful..
