My father passed away without writing a will on his property. The property is only a plot and there no other movable assets. My siblings and I have decided to transfer the property to my mother. My questions are: 1) Do we need a legal heir certificate or a succession certificate? 2) I have family member certificate with all my famil member details, is that the same as legal heir certificate?
Your mother needs the heir certificate, as is required to transfer the assets of your deceased father. The family member certificate if contains the date of birth of each member then you can attach it's photo copy with the application for heir certificate of your mother. The basic requirements for the heir certificate:1) Signed application form of your mother. 2) Her identify/address proof and DOB certificate. 3) Her self undertaking Affidavit. 4) DOB certificate of your late father and his address proof. 5) His death certificate.
