Stolen jewellery Replacement

Hello everyone,

On the march my grandmother  stepped out of the house to the nearby provision store at aroud 3 p.m.  Two fellows in a bike came from the opposite direction and snatched her chain of 72 grams. My grandmother was totally oblivious of the fact until she saw them zip past her after they took the chain. 

police came to the spot and register a case and gave FIR copy. Fortunately the incident was captured in a video footage but the culprits' face was not captured.

After 3 months now the police say they have recovered some gold (of some other case, where a Burglar, not a theif was captured ) and wish to give 40 grams worth to us. This was communicated to us by the Inspector.

I wish to know 

1) can the gold be recovered without taking the case to court?

2) If no, what is the procedure to recover the jewel via court procedure ?

3) how to put a petition when the courts are on SUMMER Holidays until june 1?

4) if there is a delay in my petition filing, will the police hand over the jewel recovered to some other case ?

Please, throw some light on these issues, i wish to know the details from the Learned Members of this group.

This is not the first case. What does superdari mean?
