Stamp duty calculation for the old property (mumbai)

I am resident of a building which was constructed in Mumbai Borivali (W) in the year 1978, now after long struggle society has decided to go for conveyance process. Regarding this I have a following query.

  1. One of the flat owner bought flat in 1978 and they registered their flat but they failed to pay stamp duty, at that time for flat registration purpose stamp duty was not compulsory.

I.If he want to pay the stamp duty now then how the stamp duty cost will be calculated.

II.Can he pay the stamp duty now or he has to wait till society submit the documents to Deputy Registrar office for conveyance and then deputy registrar will scrutinize the document and then only deputy registrar will say the amount to be paid to for stamp duty and after that only flat owner can pay the stamp duty amount and not before that.

 

In second case flat is not registered nor paid stamp duty. Then what will be the process, how the stamp duty charges will be calculated and penalties if any.
