Shift duty

what is the Shift duty rule in india?

i am working in a MNC we are having Roster of seven days duty, 2 days Morning shift+ 2 days Evening shift+ 2 days Night Shift +O total seven day. our off come after night shift which end at 6:00 am after that off day (24 hrs).suppose night shift end 6:00 am on sunday, so sunday is your off day and on monday 6:00 AM(morning) is start of next week.whole off goes in rest after night duty.literally no off day.

but in many other companyafter night Shift they given rest day and than Off daytotal 8 days shift.

The MNC is what: Commercial, Industrial Establishment?

Look intom the enactment that applies to it e.g; Shops & Estbs Act, and Shops & Estbs Rules

 

If required check with Inspector appointed under the Act.

Take cues from Employee's Unions also.

The rules that are framed after negotiated with unions are usually available on union websites also in addition to website of the establishment.

The Factories Act, 1948:Chapter VI: the notice period of work, fixed in accordance with the provisions of Act should be displayed in the factory.....change should be notified to the Inspector, before the change is made.

Factories Act: weekly holiday on the first day of the week, which is Sunday or may be any other day, as may be approved in writing by the Chief Inspector of Factories, for a particular area is necessary.

Section 52:Provision for substitution of weekly holiday so that by complying with the requirements of this section, workers may be permitted to work on the day of weekly holiday. Provision also specifies on allowing compensatory holiday, in lieu of unavailed weekly holiday.

Factory Act: 53. COMPENSATORY HOLIDAYS. - (1) Where, as a result of the passing of an order or the making of a rule under the provisions of this Act exempting a factory or the workers therein from the provisions of section 52, a worker is deprived of any of the weekly holidays for which provision is made in sub-section (1) of that section, he shall be allowed, within the month in which the holidays were due to him or within the two months immediately following that month, compensatory holidays of equal number to the holidays so lost. 


(2) The State Government may prescribe the manner in which the holidays for which provision is made in sub-section (1) shall be allowed.
