after perusual I came understand that the Hon'ble Supreme Court Partly allowed the appeal filed by the employer aggrieved over the Tribunal order and the same was set aside and directed the employer to verify his(legal assistant) service record as legal assistant and pay the honorarium if due and the same adjusted from his wages.(By my opinion as per judgement he was not eligible for the post of legal assistant due to lack of law degree and the rules also not permitted the employee to absorb another vacancy though person having deficiany in education and further the post also to be recruited through UPSC).

Sudhir Kumar, Advocate (Advocate)     12 May 2017

what are facts of the case.

As per judgement you are entitiled to wages or salary but direction given to your employer to decide the service rendered by you from when and you have said the service rendered by you from 1996 but your employer said srevice rendered from 2008.whatever it is you have rendered service as legal assistant and definitely you may get wages or salary,if it is calculated based on wages each day accountability will taken place or salary basis pay scale of the post to be calculated.(confusing ! yes it is each day).

Please give a reply on wages for day? Or for period? High court given in its order is said period

It is upto your employers decision and nature of your post, verify with your employer or upsc regarding the payment mode and payscale of legal assistant post.if it is wages basis you will receive wages or salary basis you will receive salary and court does'not want to enter deciding period of service because you are saying from 1996 they are saying 2008 hence the court directed the employer to verify the actual period and pay the same.
