Sec 425 and 427 ipc

An employee from a nationalised bank was deliberately not allowed to work even though he reported for duty for a week and then he was shown as absent and proportionate salary was deducted.

However, no information or intimation of salary deduction was given to him.  No inquiry was conducted.  The employee had on the same dates (of forced absence) lodged complaints with labour commissioner.  He also has documentary and oral evidence for his reporting to duty.


THE QUESTION IS:

CAN THE CONCERNED PERSON BE CRIMINALLY PROSECUTED U/S 425 AND 427 OF IPC?

Not only theoretically but practically is it possible to get the criminal complaint tried?

Futile exercise. It is not possible.
