Sc judgment of aquittal in 306/498a where mother of deceased has not become witness in the case

Dear Esteemed Lawyers Request if someone can help me with a citation/judgment (I think there is one of a constitutional bench) wherein one has been acquitted from the charges of 306 and 498A due to the fact that deceased MOTHER DID NOT BECOME WITNESS in the case. pls help
