Roof right

the building owner has sold the top floor to me with roof right and now after 16 years the building owner who is staying in first floor is constructing a new floor on the roof without taking my NOC. Can he do that? or if he does so will I also be getting the share of the constructed property. Please let me know.

Thanks for your reply, In my sale deed it is mentioned that I have a roof right.
