Right to sue

 

A enters into a contract with B to work as a Driver at C’s residence on Contract Basis. It is a condition of the contract that A is required to complete a period of 6 months minimum and if A leaves before that he will pay a penalty of Rs 10000 to B, who was instrumental in arranging this work contract for A. A leaves the Contract before the agreed tenure. Please let me know Can B sue A for damages of Rs 10000/- keeping in mind the fact that C makes the works payment directly to A  and that B was paid an a fixed amount by C for facilitating this contract.

 

What difference would it have made if the payment to A by C had been routed through B
