In 2010 the SC passed a judgement which disallowed builders/developers from selling parking spaces to flat buyers.

I purchased a flat and a parking space from the builder in 2005. My questions are 

1. Can the society claim to own my parking space citing this judgement?

2. Is the judgement "retrospectively" applicable?

3. If the above are true, how can I recover my money from the builder?
