Rejoinder

I have filed suit for declaration of title on basis of adverse possession and defendant have filed counterclaim . Now have to reply to counterclaim . What will be better , either written statement or filing rejoinder.

      What is difference between written statement and rejoinder.

I have to raise the plea of adverse possession again as a defense to counterclaim.

If it is suit, then there will be written statement by the defendant and replication by the Plaintiff.

If it is a petition (writ petition etc.) then there will be counter affidavit by the Respondent, and rejoinder by the petitioner.

Therefore, you have to first understand that written statement will be filed by the defendant, rejoinder (if you want to call it so instead of replication) to that by the plaintiff (i.e. who initiated the suit).
