Can any of the person in the heirship certificate who has relinquished their rights previously in any registered deed come back after years and ask for their share?

No, if the person has given a release deed regarding the specific property

Partition deed executed among 4 heirs of X (X's mother aged 93, wife aged 59 and 2 children), X's mother and wife have given up their share to children. Can X's mother or wife come back for their share after 5 years or revoke the partition deed through court?

T. Kalaiselvan, Advocate (Advocate)     08 March 2015

Any deed especially unconditional, for transferring the rights of the property unto another person cannot be revoked on their own and even if they approach court for cancellation, they may have to prove the substantial reason seeking the same with concrete evidence in their side. Now if this partition deed and the release deed have been duly executed and registered in the names of the beneficiaries, it loses ground for revocation until if any condition imposed therein have not been duly complied therewith rendering the said deed infructuous.
