Reg reimbursement of salary drawn in case resignation

Sir,

At the time of joining an organistion I have executed an agreement on Stamp paper with my employer

under which a clause states that "employee agrees to compensate entire salary drawn during the probationary

period, in case employee opt to leave the job by way resignation within stipulated period of THREE YEARS"

Q: 1 can I give ONE MONTH'S notice or reimburse ONE MONTH SALARY in lieu of one month notice

Q. 2 can I get any legal protection under above since, I am leaving the job for my better prospects.

       Will it be obligatory on my part to full fill the condition as noted above under agreement already executed.

Q  3   Can my employer with hold my original testimonials if I don't reimburse the salary drawn during my service

          ( 8 months) and my probationary period not completed and my service not confirmed yet.  

        I am reimbursing ONE MONTH SALARY

You state you have signed agreement. What are the contents ? Whether resigantion accepted? Wthout these details opinion cannot be given.
