Redevelopment of pagadi chawl

hi everyone need ur help to clear few things .

we are the landord & r planning to redevelop the building which has pagadi system.

built in 1951in malad west.

there r 26 tenants in our building of which 4 occuppy above 300sqft, 14 with 205 sqft, 4 around 150sqft and 4 below100sqft.

we have agreed to give them 15% extra area & 40/sqft as rent for alternate accomodation.

few questions ?

1. is there any rule that we need to give minimum 225sqft to all tenants ?

2. what is rate /sqft for rent that should be given for alternate accomodation?

3. what if 80% tenants agree & 20% do not?

Hi There 

This is Hemant Bhatia who had developed his property in Vile Parle East, There is a Bombay High Court Judgement that if majority of the Tenants agree then there is no harm in going for the Development as far as giving 225 sq ft is to be given it is covered under the FSI and you r not going to lose from your pocket. If you need any help as far as your agreement with the Developer is concerned, do feel free to contact me. Though not a lawyer have sort of become an expert in Development Agreements concerning the landlord and the Developer. My experience with my own Developer has given me enouigh insights as to how the Developers beat around the bush sweet talking with the landlord. Take Care.

so do u mean that we need to give minimum 225sqft even to ones who r occuping 50sqft,80sqft &115sqft rooms.

Hi Harsh 

 

U need to give details whether they r using it for commercial or residential purposes there are other details also necessary whether the tenancy stands in individual name and whether the second or maybe a third generation is now occupying the premises based on ancestral tenancy. Commenting off hand would not be possible.

hi everyone, now it seems that the tenants are not happy with our offer for redevelopment.

so we have decided to leave the issue for few months.

meanwhile , can anyone tell me , is there any way by which we as owners can increase the current rent to some reasonable amount.

currently the tenants in our building pay us Rs110/month for an area of 250 sqft. which i guess is disgusting ,especially considering it to be in a prime location in malad west.

Hi Harsh 

Does the rent of 110/- cover the water and property Tax. You can charge seperately for the water and property Tax. You have not specified whether the tenants are commercial users or residents.

Dear Sir,

                      We are residential tenants building at Dadar area. Total tenants are 27nos. We want to form a registered society. I want to know the procedure.

Can we form the registered society without taking the permission of landlord.?
