can an advocate practice different proffession

pls guide me, whether an advocate who has registered himself as an advocate under the state bar council of INDIA can practice different proffession or not.


Further Pls guide me is their any provision to practice proffession other than as an advocate by securing the permission from the respected council

If he is practicing how can he safeguard himself from such, and what are the procedure he should follow for the same

Please refer Adovcates Act 1961  threre soem exception with retion to family business and career related with law.

As per advocates Act We advocates
cannot be engaged in other profitable professtion while we are
practicing. If you want to be gainfully employed elsewhere youhave to
surrender your sanad.

you can take up classes as lecturer in law colleges  only is permitted by the bar council while pursuing the proffession.or else join any law firm where you can be a litigation counsel that is you will be taking care of the cases in the courts.

Yes there are restrictions for advocates to do any other profession with some exceptions as stated by other freinds.


But you can find ways out if your opportunities are big. You can be a director in a Ltd co.


You can also run buisness for the HUF , which can be existing or can be  created by partition of earlier HUF provided you have copancers for new HUF.

it is very clear that an advocate can not work as fulltimer in any other organisation. for this he or she has to surrender his license

With a law degree, there are many other professions, but as an advocate, you cannot do much in other kind of jobs

Yes, I am also consented with the opinions given. As per Sec25, a lawyer being in practice cannot go for fulltime oppertunities with any employer.

section 25 of Advocates -1961


An application for admission as an advocate shall be made in the prescribed form to the State Bar Council within whose jurisdiction the applicant proposes to practise.


Though there is no law but ruleS have been made there under in to maintain the dignity of profession.If you have enrolled as an advocate then you have to inform the bar council with undertaking that you stop to cease practise as an advocate


If the council permits you that your profession in any way doesnot affect the dignity of profession then you may go for practise

you can suspend your practice temprorily by giving a letter to respective bar counsil and once if you want to practice again you can give a letter and start practicing if you suspend the period of suspension will not be taken in to for calculating your experience in the bar this may affect if you go for any Government postings

I want to make comment that


1 Rules are made to bring integrity and nobelity for this profession.The main objective of this rule is that individual should not engae in such kind of jobs/trade that will affect the integrity of this profession


2 Ethics are different from rules.We cannot enforce the ethics but have come naturally anjd it is the faith which maintain the balance between the solidarity of profession


If we see there are many examples which we commonly see such as scams,vioalation of orders in some cases the staturory bodies have fully supported the violators despite of ruling by the Hon'ble courts.I am not stating to this profession but with reference to other professions also


First we needs to know why an individual is interested for other profession.As a part of interest??


Not at all.There may be the circumstances which detering him to opt for the others such as we see in the case of intellectual persons in the law stream are opting for corporate sector.Those who don't have god fathers in any profession will definately opt for short cuts as life of individual doesn't run in centuries


As per philosphy point of vies rules are made for weak persons so that strong person can break them easily when it is required


Please also make a note that I don't want to hurt the sentiments of any one
