Have Query on Recovery Proceedings U/s. 101 of MCS Act by Dy. Registrar as under :
Previously one of the Expert ( Sh. Hemant Agarwal) said that Dy. Registrar can not go beyond 3 Years for Recovery of Maint. dues. I made enquiries with the office of the Dy. Registrar and what they told me is, it's not true since Society has continuously demanded their dues from time to time, limitation of 3 years does not apply and we can go upto any number of years for recovery.
Can I please get any citation or case laws on the same or relevant section to show them that they can not recover Maint. dues beyond 3 Years ??
