Dear Learned friends,
My colleague is been awarded maintenance u/s 18 of HAMA. Her husband has absconded from India and doesn't comply to the maintenance order of Hon'ble Family Court (upheld by Hon'ble High Court).
She is trying for his arrest warrant but she was informed that she will lose her monthly maintenance equivalent to each month of her husband's arrest. Asked other lawyers but not getting clear answer as some says " YES" and some says "NO"
I would appreciate some one could clarify.
