Purchased property occupancy not received as per commitment

I purchased a property in Hinjewadi, Pune. The developer promised possession by Aug 2015 but has still not given possession[today is 21st April, 2016]. When question, the builder simply pointed to the agreemt where there was a clause that stated that if the builder does not provide the possession as committed the the refund can be sought less some charges. Many a times, these kind of clauses go unnoticed. Now we are left in a lurch. If I ask for a refund, I get lesser money than what I invested - today's rate as increased. If I wait, I don't know when I will get possession as the builder has smartly drafted the agreement - he knows gullible customers don't read every print on the agreement and are told everything is a standard. I am losing out on possible rent. Please can you advise. Thanks
