Punishment for harassment in office

Dear Sir, I am working in a Limited company at Jalandhar. In our company our sales Managar often use abuse language to his subordinates. Sometime he give jolt or even slap to his juniors for such a small matters. Is there any legal remedy for this. can we take any action against him. Can we provide CCTV footage for this, or we need some other proofs as surely he will deny for his those acts. What kind of punishment he can face, if we prove it through CCTV footage. Please suggest. Threatening, abusing & man handling is a major misconduct.  I believe more number of employees are suffering from this guy.  For any legal action witness is more important & now a days it may not be difficult to record hece do it.  I suggest to obtain a written complaint from the sufferers and escalate it to higher authorties.  In case they have not taken any action then lodge a complaint in the police station so that they will take care. In the present scenario no management is ready to loose their employees hence they may initiate some action.

If you can record audio/visual in your personal device also, it shall be better.

Let it be recorded in CCTV device of employer/establishment. Does CCTV device have mike?

If no sound bites may not be available.

All affected employees may unite and stand by each other and approach local employee's/trade union leaders also.

They can lodge complaint with:

Works Commitee/Greivance Redressal Committee/HR Head/good offices of appointing Authority-MD-CEO-Chairman/Chairperson-Board

Inspector appointed under Shops & Establishments Act,

Labor Inspector (State/Central as applicable), ALC  (State/Central as applicable)

Police

With irrfutable evidence in their hands....

Mr. A Kumar,

Your question, "Is there any legal remedy for this. can we take any action against him," is strange as if you can take a direct action against your Slaes Manager under whom you are working as a subordinate.

Legal remedies are there, but you cannot take any action directly against your Sales Manager through a court of law Only your company can take any administrative or legal action against that fellow, not you. At the most, you can approach the higher management along with proof of harassment, if any with you.
