Protest petition


Respected Experts of the LCI Club,

This is in continuation to my query posted on 1st Jan. 2015 & subsequent reply for it by the LCI Experts. As the Complainant of the Criminal Case for forgery etc. turned out to be a Defacto - complainant because of the Police on alleged investigation filed a Charge Sheet without any documents confirming commission of crime by the accused, inspite of such documents along with the Complainant's Private Complaint was forwarded to the police by JM Court  while giving Direction .

As suggested by the Experts, a Protest Petition was filed in JM Court & the Court has asked the Police to submit their Counter for the Protest Petition. After a prolonged delay, the Police have filed their Counter which states that they have not received any documents along with the Pvt. Complaint & requested the Court to dismiss the Protest Petition. Next hearing is posted for 3rd May 2016.

Under this condition, to get justice, I request our Experts to suggest necessary remedial actions to be taken by the Defacto - Complainant.

inspite of such documents along with the Complainant's Private Complaint was forwarded to the police by JM Court  while giving Direction .

 

in this case you must have the order of jm court giving direction to the police along with document and complaint. just show that order of jm court in your protest petition hearing. this will prove that police is lying.

Dear Mr.Arix,

Thanks for your reply. Infact while filing the FIR, the IO has referred the Direction Note issued by the Magistrate. It is quite strange inspite of that, the IO states now in his Counter to the Complainant's Protest Petition no any documents received. However as the Complainant have Court Certified copy (CA) of the Direction Note issued by the Magistrate, the same will be submitted during next hearing as suggested by you.

Without going into details it is Prerogative of magistrate to allow or disallow protest petition, as per you stand it should be positive, in case disallowed revision petition in high court is advisable.
