Property succesion

Hello There,

I have purchased a property a few years ago. The property is in the Name of Mr. A and he had expired at the time. He had a wife , 2 sons and and a mother. Both the sons and the wife have signed for the dcument registration.

The Mother of Mr.A expired after Mr. A and now do the brothers of Mr A ie other sons of the Mother of Mr A - do they have a right on the property and to what extent if so.

Look forward to someones help.

Thanks in advance

T. Kalaiselvan, Advocate (Advocate)     23 December 2014

A's property after his death will be intestate, that is it will devolve upon all his legal heirs which includes his mother too.  If the mother survived A on his death, she will be entitled to a legitimate share in the property and that particular share, upon her intestate death, shall again devolve upon all her surviving legal/predeceased legal heirs (upon surviving legal heirs of the predeceased legal heir) equally.  Therefore, if her other sons and daughters claim a share in their mother's share of property, it should be dealt with it accordingly you cannot deny it.
