Property fraud issue in gurgaon

Sir, I need your help. We 4 people had purchased 4 seperate plots. We are having our seperate registries and mutations entered at Tehsil, still we are not getting possession. for example: property dealer purchased 200 ft area of land. He do plotting and sell 200 ft land to people and get their registries done. But where is the RAASTA. He had to deduct the land that goes in RAASTA. He sell his complete land- purchased 200 and sold 200 ft.

Tahsildaar and Patwaari had entered our mutuations, but they also had not deducted the land of RAASTA.

Our case was inquired by SDM-Pataudi - he clearly writes in his report that the other party had done fraud and being a fraud case this should be investigated by Police.

We filed complaint with Police - the same is inquired by an ASI and he closes our complaint by showing it as CIVIL matter and closes it with the help of unauthorised eminent person.

Further our complaint was reinvestigated by ACP-Pataudi, he investigates the matter, and closed our complaint by taking report from DDA (Police legal advisor) - He had written in his remarks- In my opinion there is no criminal action for initiating on complaint of the applicant. Matter belongs to civil nature, so direct applicant to go to Civil court for redressal of his grivances.

Sir, this is a case of 420/cheating, we 4 persons are not getting our land, and two Sub divisional magistrates had clearly written it as FRAUD, but still Police is making it a Civil Matter.

Police is absolutely correct.

Please approach the Civil Court, without wasting time.

'Buyer Beware' applies to property deals. It shall be appropriate to get proper legal opinion from a very able local senior counsel of unshakable repute and integrity specializing in revenue/property/civil matters before signing or making payment. This may cost some FEE but ONE can defend long term interest and hard earned monies.

If the police refuse to register FIR under section 154 Cr.P.C than move application under section 156 Cr.P.C in the court of Illaka Magistrate for giving order to Police to Register the FIR u/s 420 IPC.
